Marijuana Legalization: What Should Businesses Do?

As of today, Oregon has joined three other states--Alaska, Colorado, Washington--and Washington DC, to allow possession and cultivation of recreational marijuana. Sure, this may be a date of celebration for some--however, businesses and employers are left to handle the ambiguous law of implementing drug-testing policies. There will be a lot of confusion, but staying informed on your state’s marijuana laws will allow you to maintain a safe and productive workplace.

Can you still drug test?

Businesses that are federally-funded are required to comply with the federal ban on marijuana use. Regardless, businesses have the right to keep their workplaces drug-free. Drugs cause impairment, and can decrease productivity in the office. Drug abuse is a serious issue that can result in the death of the user and can also potentially affect and harm others around them. Make sure that your drug-testing policies are up-to-date and compliant with the new laws.
